Terms of Use

These Terms of Use (“Terms”) form a binding agreement between you (“you”, “the user”) and FaceyIT FZ-LLC, Ras Al Khaimah, United Arab Emirates (“FaceyIT”, “we”, “us”), governing your use of the Teluma iOS application (“the App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, in accordance with these Terms and the Apple Licensed Application End User License Agreement. You may not copy, modify, reverse-engineer, redistribute, or resell the App except as permitted by law.

The App, its name “Teluma”, its logo, design, and software are owned by FaceyIT FZ-LLC and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding. Content accessed through your playlists belongs to its respective rights holders.

6. Disclaimer of warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any particular playlist, stream, or third-party service will function, remain available, or be of any given quality. Stream availability and quality depend entirely on your provider and your network.

7. Limitation of liability

To the maximum extent permitted by law, FaceyIT FZ-LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App or any content accessed through it. Our total aggregate liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless FaceyIT FZ-LLC from any claims, damages, or expenses arising out of your use of the App, your playlists and content, or your breach of these Terms.

9. Termination

These Terms remain in effect while you use the App. We may suspend or terminate the license if you breach these Terms. You may terminate at any time by deleting the App. Sections that by their nature should survive termination (including 5–8 and 10) will survive.

10. Apple as third-party beneficiary

This agreement is between you and FaceyIT FZ-LLC only, not with Apple. Apple is not responsible for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any maintenance, support, and warranty obligations are FaceyIT’s alone, not Apple’s.

11. Governing law

These Terms are governed by the laws of the Emirate of Ras Al Khaimah and the applicable federal laws of the United Arab Emirates, without regard to conflict-of-laws rules. Disputes shall be subject to the competent courts of the United Arab Emirates, subject to any mandatory consumer protections in your country of residence.

12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date reflects the current version, published at teluma.app/terms. Continued use of the App after changes constitutes acceptance.
